I guess you can use it as long as you don't make any profit from it. Photo pack all are unofficial addons and are free, so you can say that they are for personal use, which is allowed, I think. Anyway, I don't know much about it, so I could be totally wrong...

It's the same thing i guess, anyway another idea could be insert a txt file with the credits, at least i quote from where i took pictures....

It's all a bit dodgy tbh.
As far as I know, third parties have no right to use other people's photos regardless of the purpose. I don't think you're even allowed to store them on your own hard disc!!!
I don't think many photographers will mind since there's no profit being made. Just put something in the readme.txt saying that if the copyright owner wants it removed then they can e-mail you, etc.

I have made a couple of addons for EA NHL series and also a small SLO facepack for EHM and no one has ever e-mailed me to remove his/her photos.
There are tons of addons for all kind of games and I dont believe anyone has time to check them all and sue the authors. Well maybe in the USA ( were everything is possible

)

I think you'll get a request to move the offending material before the owner took anything drastic.
If they sued you, I can't imagine they'd get any or much compensation since no profit was made. It would cost more to bring the case to court.

There are some great facepacks for NHL 2004, I will ask the authors if we are allowed to use their work for EHM if we gave them proper credit.

im not sure on the legal ins and outs, but most cm skins and menu bars use what ever picture they can find and want to use and nothing is ever said about it.
tbh i dont think anyone would come knocking on your door if you did use a certain picture

The copyright police don't do a lot of work you know....
But if you do this you are 'technically' breaking the law I would imagine in most countries. For sure in Canada.
